As some of you may know, my HP MR2 was destroyed in a fire recently. On the day after the fire, the Koni 8611's I ordered from Truechoice arrived. I called them that day and explained my situation.

Their return policy is clear:

No returns will be accepted without proper return authorization. Returns will be accepted only if the parts are returned within 15 days of receipt and are in new condition, including original packaging and packing slip or invoice. Our RGA# (Returned Goods Authorization) must be displayed on all returned packages.

Today, I received this e-mail from them after asking for an explanation of why I can't return them:

Hi James,

Sorry they had already shipped. We don't have any money right now to do a return.

The money you spent on them was used to purchase them and ship them.

We really didn't make anything on them and everyone is waiting to see

what happens with this Covid-19 thing going on. No one is spending money.
We may be able to do something at a latter date but it is impossible right now.
I am very sorry,



I've written to Koni North American to complain and will be filing with the Ohio State's Attorney if they don't make this right. Obviously, I am willing to eat shipping, but a flat "sorry, pal" doesn't work for me.

Did you pay by credit card? If so, contact your card issuer. If the vendor did not follow its published return policy, the card company may very well claw the money back and send you a refund.

My experiences over the years have shown me that card companies are willing to go to bat for you.

It was a Visa debit. I've not heard of that on debit cards.

Sounds like both of you are in rough spot....not of anyone's making.

Couldn't help but wonder, just how much you're in/out on these struts? Any thought to putting them up for sale, here or elsewhere? both ends, or one? Might solve the immediate dilemma. MIght be something for MR2OC.com, too...

I must say I've always had good results with Truechoice, over the years... Much smaller operation than when Jim T. was alive/involved, but still doing me right. Can't say they are trying to stick it to anyone, more likely short term cash flow issue......special parts, with limited resale, doubt Koni will be into doing much....for sure Turechoice didn't expect either that fire or the virus...sure tight at that end, too.

Just seems like something needing consideration.

I prefer doing business with small shops. However, I don't feel like I should have to ask for a financial statement from them before I make a purchase. Don't advertise a refund policy if you aren't going to stand behind it.

Was there any insurance from the property or the company that caused the fire?

Sorry, man. I'm out. I'm going to the dark side. Looking for a Spec Miata. It was fun racing you though.

The insurance claims and lawsuits will probably go on for years. The only winners will be lawyers.
